According to the indictments seen by ARAGÓN DIGITAL, prosecutors place the alleged incidents in December 2023, when the defendant was alone with the girl at the family home. The Public Prosecutor’s Office attributes two episodes to him, occurring just a few days apart, and considers them to constitute a continuing sexual assault offense.
After one of the episodes, the girl was taken to hospital after experiencing discomfort and difficulty urinating. A medical examination found a small, nonspecific erythema, which forensic doctors from both sides debated at length on Monday. The private prosecution, represented by María Floria Gil on behalf of the mother, also maintains that the girl subsequently developed psychological and continence problems that it links to what happened.
DEFENSE SEEKS ACQUITTAL
The defense of R. C. J., represented by attorney Claudia Melguizo, requested his acquittal on Monday and denies that the assaults described by the prosecution and the private prosecution took place. Its position is that the complaint arose from a dispute between the parents over custody and that the defendant himself initially expressed concern about behavior by the girl related to one of the episodes under investigation.
The defense has also questioned the interpretation of certain elements added to the case and maintains that some reports point to the possible manipulation of the girl in the parental dispute. The evidence presented in the proceedings includes the girl’s examination as pre-constituted evidence, as well as medical, forensic and psychological reports.
The Public Prosecutor’s Office is seeking 15 years in prison for R. C. J., 20 years of disqualification from any profession or activity involving regular contact with minors, and compensation of 10,000 euros. The private prosecution is also seeking 15 years in prison, raises the civil liability claim to 30,000 euros and requests, among other measures, a 20-year restraining and no-contact order protecting the girl.
