In the indictment filed by the Public Prosecutor's Office, it states that the events took place in 2023 and that the accused (E. N. L.) attacked the two victims “driven by his prejudice regarding their sexual orientation.”
The events took place on Pamplona Street in Madrid, when in November three years ago, the accused noticed two women kissing in the street. The prosecutor maintains that it was then that the accused, “driven by his prejudice regarding their sexual orientation,” approached them. When he reached the victims, the accused, “in complete rejection of them,” put his hands on his genitals and began insulting them in a “derogatory” manner, “audible to people in the vicinity,” even “spitting at them.”
“DEGRADING” ACT
The insults uttered by E. N. L. included various derogatory terms, including the word “lesbians.” The prosecutor said that these actions were carried out in a derogatory manner and loudly enough to be heard by people nearby.
The insults were repeated several times while the accused put his hands on his genitals and made other obscene gestures, even spitting at the two women. For these acts, prosecutors are seeking 18 months in prison for an offense against dignity, while also demanding civil compensation of 750 euros for each woman for the moral harm caused.
The victims have not expressly waived their right to compensation due to the clearly “degrading” and “disparaging” nature of his behavior, “which undermines the dignity of the people targeted and of the group to which they belong.”
