Legal report finds €12 million claim against Tiro de Pichón is not time-barred

Zaragoza City Council can still pursue nearly €12 million from Sociedad Deportiva Tiro de Pichón over the expropriation of land along the Ebro riverbank. Urban Planning Councillor Víctor Serrano presented a report by the Municipal Legal Advisory Office on Tuesday concluding that the claim has not expired and that the suspension of the implementation of the October 2022 plenary agreement remains in effect under the law. According to Serrano, the report also finds that the company’s appeal for reconsideration, filed in December 2022, should not be resolved now because it could conflict with the pending court ruling.

Serrano defended the fact that they had acted with "prudence", "soundness" and "legal rigor" and reiterated the municipal government’s willingness to seek the amounts owed once a final ruling has been issued. The judgment is pending deliberation and a ruling and will have to determine whether the boundary demarcation carried out by the Ebro River Basin Authority in 2022 was correct, affecting more than 11,000 square meters. If the position defended by Zaragoza City Council and the CHE is upheld, the council would seek the corresponding compensation amounts.

The councillor presented the report as a response to questions raised in recent weeks by opposition groups over the possible expiry of the claim. Serrano also assured that the document had been sent to all municipal groups as soon as it was received and stressed that the Legal Advisory Office’s conclusion "protects" the municipality’s interests by keeping open the possibility of recovering the money.

PSOE CALLS FOR AN EXPRESS SUSPENSION AND GUARANTEES FOR THE MONEY

Against this interpretation, PSOE councillor Marta Aparicio questioned whether the proceedings should remain suspended due to administrative silence. She argued that the legal report "should have been completed four years ago", when the procedure began, and called for any continued suspension to be imposed "expressly", with the legal, technical and financial reports necessary to protect the municipality’s interests.

Aparicio focused on the lack of guarantees for the nearly €12 million that the city council intends to recover. "We have not requested either bonds or guarantees," she said, and asked what would happen if Sociedad Deportiva Tiro de Pichón disappeared or changed its name. In her view, that situation could make it more difficult to recover the money if the ruling ultimately upholds the city council’s claim.

The political dispute over the proceedings will in fact reach the municipal plenary session this Wednesday, after the opposition called in recent weeks for the pending appeal to be resolved. Vox formally requested the Legal Advisory Office’s report to clarify doubts over a possible expiry, while Zaragoza en Común has proposed calling an extraordinary plenary session to address the situation.
